So presumably, that means the 'driver' would have to remain awake, and focused on the driving task, ready to take over, wouldn't they...?

Which means the whole idea of a driverless car is completely wasted.

Actually, if you think about it, especially during development, that's not the problem.

The problem is whether the attending driver is sufficiently aware and involved to take over swiftly and appropriately.
Your 'standard' is how you drive alone, not how you drive during a test.
